Ask an Attorney: Enhanced Underinsured Motorist Law

If you or family members have had the misfortune of being injured in a motor vehicle collision as a result of someone else’s negligence you may have also encountered the problem that the other driver did not have sufficient insurance to cover your losses.  Skyrocketing medical costs coupled with the minimum amount of insurance Marylanders are required to carry often leave injured victims unable to be made whole after an accident.

Having sufficient uninsured/underinsured coverage on your own policy is one way to protect you from unreimbursed losses.  In addition, in 2018 the Maryland legislature passed a new law to improve your ability to protect yourself.  Under the new Enhanced Underinsured Motorist law, you can obtain increased protection for any occupant of a vehicle insured in Maryland who is injured due to the fault of an underinsured driver.  You should contact your auto insurer to find out how you can add this increased protection to your policy.
